Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PropMaster platform at propmaster.intromatic.ai and any related services, applications, or APIs (collectively, the “Service”), operated by Intromatic (“we,” “us,” or “our”). PropMaster is a product name and brand operated by Intromatic; it is not a separately registered business entity or “doing business as” (DBA) name.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration & Security

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must notify us immediately at support@intromatic.ai if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

PropMaster is a real estate market intelligence platform that aggregates publicly available auction data (tax deed, tax lien, and foreclosure sales), enriches it with public property records and market indicators, and provides AI-generated investment analyses.

The Service includes, but is not limited to:

  • Aggregation and display of auction listings from county government sources.
  • Property enrichment with public record card data, assessed values, transfer histories, and zoning information.
  • Market analytics including historical home value trends, growth indicators, and population data.
  • AI-powered opportunity scoring and investment analysis reports.
  • Photo request coordination with affiliated real estate professionals.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.
  • Scrape, crawl, or use automated means to access the Service beyond what is provided through our APIs and interfaces, without our prior written consent.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Attempt to gain unauthorized access to our systems, other users’ accounts, or data not intended for you.
  • Redistribute, sublicense, or resell the Service or its data without our prior written authorization.
  • Use the Service to harass, abuse, or harm another person or entity.
  • Introduce viruses, malware, or other harmful code into the Service.
  • Misrepresent your identity or affiliation with any person or organization.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its software, design, text, graphics, logos, scoring algorithms, AI models, and data compilation, is owned by or licensed to Intromatic and is protected by copyright, trademark, and other intellectual property laws. “PropMaster” is a product brand of Intromatic.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes, subject to these Terms.

5.2 Your Content

You retain ownership of any content you create within the Service (saved properties, notes, configurations). By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

5.3 Public Data

The Service aggregates data from publicly available government and institutional sources. We do not claim ownership of underlying public records. Our value-add consists of the aggregation, enrichment, analysis, and presentation of such data.

6. Data Accuracy & No Warranty of Completeness

While we strive to provide accurate and up-to-date information, the data presented through the Service is sourced from third-party public records and may contain errors, omissions, or delays. Data may not reflect the most current status of a property, auction, or market condition.

We do not warrant the accuracy, completeness, reliability, or timeliness of any data or analysis provided through the Service. You acknowledge that real estate data is subject to frequent change and that public records may be incomplete or inaccurate at the source.

7. AI-Generated Content & Investment Disclaimer

The Service provides AI-generated analyses, opportunity scores, and investment insights for informational purposes only. These do not constitute financial advice, investment advice, legal advice, tax advice, or any professional recommendation.

  • AI-generated content may contain errors, hallucinations, or inaccuracies.
  • Opportunity scores and rankings are algorithmic estimates and should not be the sole basis for any investment decision.
  • You should consult qualified professionals (attorneys, financial advisors, real estate professionals, tax professionals) before making any investment or purchasing decisions.
  • Past performance data and historical trends do not guarantee future results.
  • We are not a licensed real estate broker, financial advisor, or investment advisor.

8. Third-Party Services & Data Sources

The Service integrates with and relies on third-party data sources, APIs, and infrastructure providers. We are not responsible for the availability, accuracy, or practices of these third parties. Third-party services are governed by their own terms and privacy policies.

Temporary disruptions in third-party services may affect data freshness or availability within the Service. Such disruptions do not constitute a breach of these Terms.

9. Fees & Payment

Certain features of the Service may require payment. If applicable:

  • Fees will be communicated before you incur any charges.
  • All fees are non-refundable except as required by applicable law or as explicitly stated.
  • We reserve the right to modify pricing with 30 days’ prior notice.
  • Failure to pay may result in suspension or termination of your access.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INTROMATIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM YOUR RELIANCE ON DATA, ANALYSES, AI-GENERATED CONTENT, OPPORTUNITY SCORES, OR ANY OTHER INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO INVESTMENT LOSSES, PROPERTY PURCHASE LOSSES, OR FINANCIAL LOSSES OF ANY KIND.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that (a) the Service will be uninterrupted, error-free, or secure; (b) any data will be accurate or complete; (c) AI-generated analyses will be correct; or (d) the Service will meet your specific requirements.

12. Indemnification

You agree to indemnify, defend, and hold harmless Intromatic and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any investment, purchase, or business decision you make based on information obtained through the Service.

13. Termination

  • You may terminate your account at any time by contacting us at support@intromatic.ai.
  • We may suspend or terminate your access at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms.
  • Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 5, 6, 7, 10, 11, 12, 14, and 15) will survive.
  • We will handle your data post-termination in accordance with our Privacy Policy.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Florida. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Intromatic regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
  • Notices: We may provide notices to you via email to the address associated with your account or through the Service. Notices to us should be sent to legal@intromatic.ai.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top and, where appropriate, notify you via email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
